A multi-million dollar legal battle over Martin Scorsese's Oscar-nominated movie The Wolf of Wall Street is heading to court after a judge gave a former stockbroker permission to sue over his depiction in the film.

Leonardo DiCaprio starred as corrupt trader Jordan Belfort in the 2013 drama, which was based on the broker's 2007 memoir of the same name.

However, the filmmakers subsequently came under fire from Andrew Greene, a former employee of Belfort's stockbroking firm Stratton Oakmont, who took legal action last year (14) over claims he was portrayed as a scoundrel in the movie.

Greene, who is said to have inspired the character of Nicky 'Rugrat' Koskoff, faced a number of struggles bringing his lawsuit to court as a judge threw out many of his claims.

However, Greene persevered and a Long Island federal judge has now signed off on his lawsuit and given him the green light to pursue his defamation case against Scorsese's production company and Paramount Pictures, according to the New York Daily News.

Lawyers acting for the movie studio have previously insisted the film is protected by America's First Amendment, which grants the right of free speech.
