Former IMPD officer & sheriff's son Nikolas Layton avoids jail time in cocaine case

INDIANAPOLIS -- A former IMPD officer, and the son of Marion County Sheriff John Layton, will avoid jail time on a charge of dealing cocaine.

Nikolas Layton, 35, was sentenced Tuesday to three years on home detention under the supervision of Marion County Community Corrections and a $583 fine. He will also have to undergo continuing substance abuse treatment and random drug screens.

Layton, 35, resigned from IMPD after a confidential informant working for the department reportedly purchased cocaine and hydrocodone from him and two other suspects in December.

Layton had worked for the department for 10 years, and was most recently assigned to the hit-and-run investigation unit.

As a condition of the plea deal, three of the four drug charges against him were dropped, leaving only one charge of dealing cocaine.

Because of his tenure on the department, Layton will remain eligible to receive $337 a month in retirement benefits. An attorney for the Marion County Sheriff's Office – where Layton was first hired prior to its consolidation with the Indianapolis Police Department – said criminal charges do not void or eliminate and officer's retirement benefits.

Layton told RTV6 he deserves his retirement benefits, despite the charges against him.

“Despite the recent events, the last 10-and-a-half years still happened,” said Nikolas Layton. “I still protected the citizens of Marion County for 10 years.”
