Mother of 2-year-old who fatally shot himself sentenced to probation

INDIANAPOLIS -- The mother of an Indianapolis 2-year-old who fatally shot himself last May received a year on probation Friday, and an order not to own or allow firearms in her household.

Kanisha Shelton, 24, agreed to plead guilty to one count of neglect of a dependent resulting in serious injury, a level 3 felony, in exchange for prosecutors dropping the higher-level felony charge of neglect of a dependent resulting in death.

Shelton was arrested in May 2016 after her 2-year-old son shot himself with her .380-caliber handgun.

She told police she had left the boy alone for a minute to go upstairs to check on her daughter when she heard a loud "boom."

Shelton performed CPR on the boy, but he was unable to be revived and died of his injuries at an Indianapolis hospital.

On Friday, Marion County Judge Steve Rubick sentenced Shelton to three years in the Marion County Jail – all suspended except for two days already served – and one year of probation, along with a fine of $760. Rubick also ordered Shelton to attend parenting and grief classes.

Shelton also agreed not to own or allow other household members to keep guns in her home.
