KNIGHTSTOWN, Ind. -- The American Civil Liberties Union of Indiana is suing Knightstown over a cross that is part of the town's Christmas display.

The suit that was filed on behalf of a town resident claims the display violates the separation of church and state.

At issue is the Latin cross on top of the Christmas tree.

According to the suit:

The cross is the best known symbol of Christianity and Knightstown's prominent display of this symbol represents an establishment of religion in violation of the First Amendment to the United States Constitution

The suit seeks monetary damages as well as to force the town to remove the cross from the display.
