Carmel couple files lawsuit against city over flooding at their historic home

CARMEL, Ind. -- A Carmel couple is taking the city to court after several months of flooding issues at their historic home that they say were caused by construction projects being done by the city. The couple says the flooding in their home is creating an unsafe environment.  

Amy Van Ostrand and Derek Fakehany claim that construction in the Old Town district has caused major flooding in their home, which dates back to the 1860s.

The couple claims their home has been flooded at least 12 times since the construction began.

They had hoped that Carmel would fix the problem but say that after several attempts to get the city to fix the problem, they are now taking the issue to court.

The couple says mold on the property has created an unsafe environment for Fakehany, who was diagnosed with blood cancer back in April.

City leaders in Carmel say they cannot comment on the lawsuit, “It's our policy not to discuss pending litigation, but thanks for offering the opportunity.”
