WASHINGTON (AP) — A panel of federal appeals court judges is letting the U.S. government proceed with the planned execution of a man who kidnapped, raped and killed a 10-year-old Kansas girl.

The three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit on Thursday evening acted to let the execution of Keith Dwayne Nelson go forward Friday afternoon as scheduled.

The court acted less than 24 hours after a lower court judge had halted his execution, saying the law requires the government to get a prescription for the drug it plans to use.
