HENDRICKS COUNTY, Ind. -- Firefighter and former Brown Township trustee Troy Wymer pleaded guilty to misdemeanor theft and was sentenced to 364 days of probation.
As part of a plea agreement reached with Hendricks County prosecutors, an official misconduct was dismissed.
According to the probable cause affidavit, the current Brown Township Trustee Tom Kmetz reported to Indiana State Police that Wymer paid himself six extra checks from the Brown Township account totaling $9,739.50.
Wymer served as the trustee from January 1, 2011 through December 31, 2014.
Wymer told Call 6 Investigates he paid back the money when the error was discovered. “I stand by the fact that this was a series of errors that I identified, reported and corrected,” said Wymer on Tuesday. “The conclusion provided the best outcome for myself and my family.”
Kmetz is furious prosecutors reached a plea deal with Wymer.
“The prosecutor’s office never even called me to discuss the evidence,” said Kmetz. “Wymer went out of his way to make journal entries to cover this up.”
Wymer is not required to pay restitution to the township.
“It was an interest free loan,” said Kmetz. “The township lost interest on it.”
Wymer said Tuesday he is back working at the Wayne Township fire department, where he had initially been placed on paid administrative leave pending theft and official misconduct charges.
Wymer also made headlines back in 2015 when he was arrested with unlawful entry and battery.
In March, Wymer reached a pretrial diversion agreement in that case.
