GALVESTON, Ind. -- Less than a week after they voted to fire him, the Galveston Town Council has reinstated Town Marshal Shawn Durham.
In a resolution approved Monday night, the council acknowledged that it had erred when it fired Durham without conducting the removal appeals procedure for city police departments required by Indiana law.
"The Board, as an administrative agency, recognizes its error of law when it terminated Durham prior to that employee's due process right to a hearing," the board wrote in its resolution.

Durham was fired last Tuesday in a 3-2 vote by the council. He was accused in engaging in a power struggle over keys and video footage with town leaders. Some in attendance also didn't like that he brought attention to how budget cuts were impacting town safety after he was forced to let go of all of the town's reserve officers.
Durham's reinstatement might only prolong his eventual termination. The town council can still fire him after conducting the proper disciplinary procedure.
