GRANT COUNTY, Ind. -- A Marion man turned himself in Thursday morning to face five felony charges in connection with a deadly crash in November 2017.
Indiana State Police say Weston James, 45, was driving a 2004 Cadillac SRX westbound on Kern Road near Troy Avenue in Marion on November 22.
For an undetermined reason, the Cadillac crossed the center line and crashed into an eastbound 1998 Ford Explorer driven by James Bartrum, 61, of Marion.
Bartrum died from his injuries. Weston James and his 3-year-old son, who was in the backseat of the Cadillac, were flown to a Ft. Wayne hospital.
James suffered injuries to his lower legs. His son suffered a facial fracture.
In addition, A 13-year-old passenger in the Cadillac had a bruised lung and a laceration to his face.
State police say further investigation revealed that Weston James allegedly had a BAC of .11 at the time of the crash. The legal limit in Indiana is .08.
An arrest warrant was served on James Thursday morning and he turned himself into the Grant County Jail morning.
State police say Weston James is facing felony charges for causing death while operating a motor vehicle with an alcohol concentration equivalent (ACE) of .08 or more, two counts of causing serious bodily injury when operating a motor vehicle with an ACE of .08 more, operating a vehicle while intoxicated endangering a person with a passenger less than 18 years of age, and neglect tof dependent result in bodily injury. He also faces an infraction for driving left of center.
