Tenants say they're being forced out of their apartments because of renovations

INDIANAPOLIS -- People living in one Indianapolis apartment complex are frustrated after they say they were given just 30 days’ notice to move out of their homes because of renovations.

Vernita Hunter says she received a notice on October 25 saying that to "expedite the ongoing renovations" at the Cottages of Fall Creek, management was "implementing a 30-day notice to vacate" for all residents in certain buildings.

“How can they do this to people at Christmas and Thanksgiving time? Our lease is not up until March 31, 2019,” Hunter said.

The notice went on to say that if the residents wanted to continue living at Cottages of Fall Creek they would have to reapply – since the apartments are now under new management and the income requirement has changed.

One woman who currently lives in the apartments said her rent will go up nearly $200 per month if she was approved for a new apartment.

The apartment manager tells RTV6 that the 30-day notice was “just an option” so that tenants wouldn’t have to move in December or around Christmas. She says they have the option to stay 60 days or even finish out their lease; something tenants say they were unaware of and wasn’t mentioned in the letter.

Managers say they want tenants to talk to them and they are not looking to put anyone on the streets. They say if current tenants aren’t approved for a new apartment at Cottages of Fall Creek they have reached out to other, nearby apartment complexes and they are hoping to help them get approved at one of those instead.

Indiana state statute says that at least 30 days is required by either party before a lease can be terminated, but tenants say their lease says they are required to have or give 60 days notice.
