INDIANAPOLIS -- Jared Fogle's attorney has been granted extra time to file an appeal over his client's sentence after being diagnosed with prostate cancer.
Attorney Ron Elberger has been representing Fogle in his federal child pornography case. The former Subway spokesman pleaded guilty in November to possession of child pornography and traveling across state lines to have sex with minors, and was sentenced to more than 15 years in federal prison.
Fogle's legal team indicated after his sentencing they intended to appeal, as it exceeded the 5-12.5 year range they had agreed to with prosecutors in the plea deal.

On Wednesday, Elberger filed paperwork requesting a 25 day extension on filing Fogle's appeal due to his recent diagnosis of prostate cancer.
Walton Pratt agreed to the extension, pushing the date to file Fogle's appeal back to February 19.
