INDIANAPOLIS -- A juvenile suspect has been charged with murder in the fatal shooting of a Cumberland 10-year-old – but won't face charges in adult court.

The Marion County Prosecutor's Office announced it would not seek a waiver to adult court for the 13-year-old suspect, who RTV6 is not naming because he is being charged as a juvenile.

The juvenile is accused of shooting and killing 10-year-old Anthony Harmon, Jr., last month in Cumberland.

Police at the time said they did not believe the shooting was accidental.

In a delinquency petition filed Monday, the prosecutor's office asks for the juvenile suspect to be removed from his home and placed under the supervision of the Marion County Probation Department.

A pre-trial conference for the juvenile was scheduled for June 20 at 1:20 p.m.
