Jimmy John's delivery man run over by officer, winds up in jail

A Florida Jimmy John's delivery man was struck while riding his bike by an unmarked police car on Thursday, and was arrested and jailed for 12 hours until his mother bailed him out,  the Miami Herald reported. 

The Herald reported that Jimmy John's employee Mason Morales threw his bike against the unmarked police car in anger. For the bike toss, he was charged with criminal mischief. The officer called for backup, and at least 10 officers showed up to perform the arrest, Morales claims. 

Morales also claimed that the driver, Officer Kenia Fallat of the Miami police department, was on her phone at the time of the accident. Morales claims he was in plain view when Fallat's car turned a corner.

"The whole thing was pretty awful and stupid," Morales told the Herald. "I don’t think I should have been brought in for that.

Morales was also cited for failure to yield. 

The Miami police department has not responded to the Herald regarding Thursday's incident. 

Morales said he was angry as he has been harassed by Miami drivers frequently. He said Thursday's incident was not the first time he was nearly struck by Fallat. 

"I saw she was a cop so I knew I had f----- -up," he told the Herald. "This was my second run-in with this police lady. One time before in the same area she didn’t hit me but it was a near miss. She was on her phone."

"I deal with this every day — drivers who don’t pay attention to where they’re going,” Morales added. “I’ve been hit before. I broke my nose once."
