Jared Fogle files appeal, release date set

Jared Fogle has officially filed his notice of appeal, almost a month after he was sentenced to 15 years in prison for child pornography and sex crimes.

Fogle's attorney Ron Elberger filed the notice Monday.

A detailing of Fogle's arguments in the appeal is due Jan. 25, the Associated Press reports 

A spokeswoman for a national group for child abuse victims released a statement criticizing the appeal Tuesday.

"We’re saddened but not surprised that ex-Subway pitchman Jared Fogle is appealing his child porn sentence," said Barbara Dorris, outreach director for the Survivors Network of those Abused by Priests. "That’s just what predators do: exploit the legal system like they exploit their victims."

Fogle was also transferred to the federal prison in Oklahoma City after being held in a county jail in Kentucky.

That jail was under contract with the U.S. Marshal’s Office.

It is not clear if this is temporary or whether he’s still going to Colorado.

The Federal Transfer Center in Oklahoma City houses both male and female offenders with a total of 1,246 inmates, according to the Bureau of Federal Prisons.

The Seventh Circuit Court of Appeals will hear Fogle's appeal.

His official release date is July 11, 2029.
