MUNCIE — A man is suing the Delaware County sheriff, claiming the jail officers assaulted him and caused “serious bodily injury.”
Thomas A. Myers filed a lawsuit against former Delaware County Sheriff Ray Dudley and unnamed Delaware County jail officers for an incident that happened Aug. 3, 2018.
According to a police report, Myers was arrested on suspicion of auto theft and public intoxication at 1 a.m. on Aug. 3. According to the report filed by the Muncie Police Department, Myers was accused of refusing to pay a fare for a cab, attacking the driver and trying to drive the cab away.
According to the lawsuit, when he was taken to the Delaware County Jail, Myers was assaulted by the jail officers. He fell to the floor while being kicked, the lawsuit states.
“The assault by the jail officers was intentional, malicious, and served no legitimate purpose,” the lawsuit states. “The assault caused serious bodily injury to Mr. Myers.”
The lawsuit states Dudley was “deliberately indifferent” to the safety of the arrestees and inmates.
He was released later that day. No charges have been filed against Myers related to the arrest.
The lawsuit was filed on Tuesday. Myers is requesting a jury trial to recover damages from medical bills and expenses, loss of income, pain and suffering and permanent injury.
A spokesperson for the Delaware County Sheriff’s Office said the office had no comment on the lawsuit.
