Indianapolis homeowner says new construction next door is causing her house to flood

INDIANAPOLIS -- An Indianapolis homeowner says she's fed up because her house is being flooded due to new construction next door.

Therese Reckley has lived in the Holy Cross neighborhood for the past ten years.

She says the contractor started digging the foundation at 1315 Sturm Avenue in May 2017.

"In June, I had terrible flooding in my basement. I contacted the contractor and asked him if he could please come over and take a look at my basement, and he told me it was not his problem," said Reckley.

She has pages and pages of email correspondence back and forth with the city, and says she has made plenty of phone calls. 

"I am so irritated with the whole thing because I have been dealing with the contractor and the city for over a year now, with all the damages caused to my basement. And I just feel as if we are not getting any place. I mean nothing, my basement is still getting water in a year later," said Reckely.

Multiple stop work orders have been placed on the property, but according the contractor, Eric Moore, the house will be ready to go on the market in a few weeks.

Moore denied the allegations made by Reckley and claims he has attempted to solve the problems with her home.

The City of Indianapolis filed a complaint this week against Indiana REMS, LLC., the owner of the property next door to Reckley's

Among the violations listed are failing to meet minimum standards for the structure and not following multiple stop work orders issued.

"A lot of times when I call him I get absolutely no response from the contractor. Therefore, I had no other option but to go to the city and present this to the city. The city has been dealing with him however, it has been taking so long. Meantime, I have been getting a lot of water damage to my basement. At this point and time, it has been a year and I have had enough," said Reckley.

The city said told RTV6 it could not comment due to the pending lawsuit.

We also reached out to David Tang, the owner of the company building the home next door to Reckley's, but our calls were not returned. 

A court hearing is scheduled for the end of June.
